Partner Program Terms
These terms govern the partner program of Digital Marketing j.d.o.o., Otona Kučere 72, 44250 Petrinja, Croatia, VAT ID (OIB) 27989586968 (“we”), under which we pay partners a commission for referred clients.
1. Who can take part
A partner must be a company or sole trader with a tax ID and a business bank account. We do not pay commission to private individuals or to personal accounts.
2. Application and approval
We review applications by hand, usually within one business day, and may decline them without giving reasons. Once approved, the partner receives a personal referral link and code.
3. Valid referral
A referral is valid when a new client contacts us through the partner’s link or quotes their code within 30 days of their first visit. A new client is a company that has not been our client or in negotiations with us in the last 12 months. Self-referrals and referrals of affiliated companies are not allowed.
4. Commission
The partner receives a percentage of the net amounts (excluding VAT) the referred client actually pays: builds and implementations, monthly maintenance and management fees, and hosting plans. Commission runs for as long as the client pays and the program exists.
5. Tiers
- Referrer, 1–3 clients: 10%
- Partner, 4–9 clients: 15%
- Ambassador, 10 or more clients: 20%
The tier is based on the number of referred clients who have made at least one payment. A tier once reached never drops, and the new rate applies to payments after moving up.
6. Statement and payout
We calculate commission monthly, only on payments the client has actually made. Based on the statement the partner issues an invoice, and we pay within 5 business days of receiving it, to the business IBAN given in the application. Refunds to the client reduce the commission for the same period.
7. Conduct
Partners may not misrepresent us, send unsolicited messages (spam), promise discounts or terms on our behalf, or bid on our brand name in search engines and on social media.
8. Taxes
Partners are responsible for their own tax obligations related to the commission received.
9. Changes and termination
We may change these terms with at least 30 days’ notice to partners. Partners may leave the program at any time. If the terms are breached we may exclude the partner, and unpaid commission from the disputed referrals is not paid out.
10. Data protection
We use application data only to run the program and pay commission, in line with our Privacy policy.
